（二）用户对其自行发表、上传或传送的内容负全部责任，所有用户不得在本站任何页面发布、转载、传送含有下列内容之一的信息，否则本站有权自行处理并不通知用户：
1、违反宪法确定的基本原则的；
2、危害国家安全，泄漏国家机密，颠覆国家政权，破坏国家统一的；

（三）用户承诺对其发表或者上传于本站的所有信息（即属于《中华人民共和国著作权法》规定的作品，包括但不限于地图数据、文字、图片、音乐、电影、表演和录音录像制品和电脑程序等）均享有完整的知识产权，或者已经得到相关权利人的合法授权；如用户违反本条规定造成本站被第三人索赔的，用户应全额补偿本站一切费用（包括但不限于各种赔偿费、诉讼代理费及为此支出的其它合理费用）。

（五）用户或用户的代理或关联人士违反本协议或相关法律，或因用户或用户的代理或关联人士（以参与者的身份行事）所做出的行为或疏忽而产生的任何损害，概由用户自行负责。
七、拒绝提供担保
用户个人对网络服务的使用承担风险。平台对此不作任何类型的担保，不论是明确的或隐含的，但是不对商业性的隐含担保、特定目的和不违反规定的适当担保作限制。平台不担保服务一定能满足用户的要求，也不担保服务不会受中断，对服务的及时性，安全性，出错发生都不作担保。
八、有限责任

九、对用户信息的存储和限制

十、用户管理

7、另外，用户也不能传输何教唆他人构成犯罪行为的资料；不能传输助长国内不利条件和涉及国家安全的资料；不能传输任何不符合当地法规、国家法律和国际法律的资料。未经许可而非法进入其它电脑系统是禁止的；
8、若用户的行为不符合以上提到的服务条款，平台将作出独立判断立即取消用户服务账号。用户需对自己在网上的行为承担法律责任；
9、用户若在平台上散布和传播反动、色情或其他违反国家法律的信息，平台的系统记录有可能作为用户违反法律的证据。
十一、保障用户
同意保障和维护平台全体成员的利益，违反服务条款的损害补偿费用等。
十二、结束服务
（一）平台可随时根据实际情况中断一项或多项网络服务。平台不需对任何个人或第三方负责而随时中断服务。用户对后来的条款修改有异议，或对平台的服务不满，可以行使如下权利：
1、停止使用平台的网络服务；
2、通告平台停止对该用户的服务。
（二）结束用户服务后，用户使用网络服务的权利马上中止。从那时起，用户有权利，平台也没有义务传送任何未处理的信息或未完成的服务给户或第三方。
十三、通告
所有发给用户的通告都可通过重要页面的公告或电子邮件或常规的信件传送。服务条款的修改、服务变更、或其它重要事件的通告都会以此形式进行。
十四、参与广告策划

十五、网络服务内容的所有权

企业用户协议
第一章总则
第一条中国______数字交易市场（以下简称交易市场）实行会员制。
第二条为了加强交易市场会员管理，维护会员的合法权益，特制定本办法。
第三条本办法所称会员，是指遵守中华人民共和国的法律、法规、遵循本办法会籍审批程序并履行有关手续的煤炭生产企业、煤炭用户、商贸企业、行政事业单位以及具有法人资格的其他经济组织。
第四条本办法根据《中华人民共和国民法通则》、《中华人民共和国经济合同法》和国家有关条例规定制定。
第二章会籍
第五条凡在国家工商行政管理部门正式注册登记，具有独立法人资格从事煤炭产供销的企业或经济实体，其注册资本不少于 万元（人民币），年度煤炭产供销量不少于 万吨，均可申请会籍。
第六条申请加入交易市场的企业，要认真填写由市场统一印制的会员资格申请表并提供下列文件：
1．工商行政部门颁发的《营业执照》证明件；
2．税务部门颁发的《税务登记证》证明件；
3．煤炭生产、经销企业需提供《煤炭生产许可证》和《煤炭经营许可证》影印件；
4．交易市场认为需要提供的其他文件。
第七条企业递交的申请表应包括以下内容：
1．企业所在地、企业法人代表；
2．企业产供需的煤炭产品种类；
3．申请加入的理由和对市场章程及有关规定的履行承诺情况；
4．企业市场交易负责人及业务员的简历；
5．市场认为需要说明的其它情况。
第八条交易市场在收到企业会员资格申请表等有关文件后，一周内给企业正式通知予以答复。
第九条对被批准加入交易市场的申请者，由市场颁发《中国______数字交易市场会员证书》，并在交易市场上予以公布。
第十条被批准加入交易市场的申请者应在接到批准之日一周内，将会员费划入交易市场指定帐户。在指定时间内未交纳会费者，会员资格视为自动取消。
第十一条会员有下列情况之一者，将取消会籍：
1．不遵守交易市场规划，不履行会员应尽的义务；
2．不按时交纳会费；
3．被国家工商行政部门吊消注册登记；
4．违反国家有关政策法规的；
5．企业自身提出申请，经市场批准并履行有关手续；
6．市场管理者认为的其它原因。
第十二条会员申请退出交易市场，须提前30日向交易市场提出书面申请报告，说明退出理由，并办理结算帐户及其它有关手续，经交易市场批准后方可生效。会员退出交易市场会费不予退还。
第三章权利和义务
第十三条会员享有如下权利：
1．以会员身份在场内进行______交易；
2．有权利参加网上竞买或竞卖活动；
3．有权接受交易市场的培训、业务指导；
4．有权咨询交易市场提供的有关统计数据，有权了解有关______的供求信息；
5．有对交易市场发展营运重大事务提议、监督、批评的权利；
6．对交易市场运行的规章制度、管理服务有提出完善监督批评的权利；
7．享受交易市场提供的优惠政策和服务；
8．交易市场规定的其他权利。
第十四条交易市场会员必须履行下列义务：
1．会员应按时足额缴纳会费。收费标准 元/年（人民币）；
2．公司股东单位是当然的会员，不再交纳会费；
3．凡取得会籍的会员单位和会员，由交易市场提供免费电子信箱一个，并可免费为企业制作网页一个，由此网页集中反映会员的基本情况、企业简介、企业产品介绍；
4．会费实行预收制。即在每年的 月 日以前收取下年度的会费，逾期 个月未交，即自动失去会员资格。会员入会时，所交会费按入会时间计算当年度所交会费；
5．严格遵守交易市场颁发的各项规章制度，自觉接收交易市场的日常管理与监督；
6．承担并履行在交易市场签署各种文件的责任和义务；
7．不得进行干扰或毁坏网络服务的活动（包括发布反动、淫秽内容、秘密截取侵占任何系统、制造病毒等）；
8．原则上会员不得擅自超越交易市场所核准的业务范围在场外私下交易和结算；
9．会员在下列情况下，须在10日内向交易市场送交报告。
（1）企业重组、破产，企业法人、煤炭业务负责人发生变更；
（2）企业法定地址及营业场所变动；
（3）企业业务经营范围发生重大变化；
（4）交易市场或企业认为应该报送的其他情况。
10．本交易市场所规定的其它义务。
第四章会员单位联络人和企业操作员
第十五条会员单位可明确一名业务负责人和一名企业操作员。
第十六条会员单位业务负责人和企业操作员必须在会员单位登记表中予以明确，并由法人出具委托书。
第十七条会员单位企业操作员在进场交易前，必须经过培训，经考试合格，填具注册登记表，进行注册登记，取得交易市场所颁发的交易证书，方具有入市交易资格。
第十八条会员单位所派企业操作员在市场进行的一切行为，应由该会员单位负完全责任。
第十九条会员单位所派企业操作员若需变更，会员单位必须在十日内向交易市场办理变更登记手续。
第二十条会员单位在市场注册登记的企业操作员，在该会员单位解除或变更其职务时便自动失效，但其在会员单位按规定的时间办理变更手续之前的一切行为，仍由会员单位完全负责。
第二十一条会员单位的企业操作员应遵守市场章程及其它各项规则。
第二十二条获准退出交易市场的会员，其企业操作员的注册登记自动失效。
第五章仲裁和处罚
第二十三条会员单位及其企业操作员在交易中发生纠纷、违约、违规及其它违反交易市场规定的行为，交易市场有监督、调解、仲裁及处罚的权力，并视其情况按交易市场制定的有关规定执行。
第六章附则
第二十四条以上各项条款如有与法律条款相抵触的内容，以法律条款为准。
第二十五条本办法的解释权属于中国______数字交易市畅.
第二十六条本办法自二零零一年九月一日起开始实行。
搜房网用户协议
1．协议生效条件
搜房网的各项服务的所有权和运作权归搜房信息资讯有限公司。搜房网提供的服务将完全按照其发布的章程、服务条款和操作规则严格执行。用户完全完成注册程序，便成为搜房网的注册用户，将得到一个密码和帐号，同时此协议即时生效。用户有义务保证密码和帐号的安全。用户对利用该密码和帐号所进行的一切活动负全部责任；因此所衍生的任何损失或损害，搜房网无法也不承担任何责任。
2．注册义务
搜房网运用自己的操作系统通过国际互联网为用户提供网络服务。同时，用户必须：
（1）自行配备上网的所需设备，包括个人电脑、调制解调器或其他必备上网装置；
（2）自行负担个人上网所支付的与此服务有关的电话费用、网络费用。
为了能使用本服务，您同意以下事项∶
1）依本服务注册表的提示提供您本人真实、正确、最新及完整的资料；
2）维持更新您个人用户信息，确保其真实、正确、最新及完整。若您提供任何错误、不实、过时或不完整的资料，并为搜房所确知，或者搜房有合理的理由怀疑前述资料为错误、不实、过时或不完整，搜房网有权暂停或终止您的帐号，并拒绝您于现在和未来使用搜房全部或部分的服务。
3）您注册的用户名不能侵犯他人合法权益，不能对他人名誉权造成侵犯。搜房有权收回对搜房或者他人合法权益有侵犯嫌疑的帐号。
3．隐私制度
尊重用户个人隐私是搜房网的一项基本政策。所以，搜房网不会在未经合法用户授权时，公开、编辑或透露其个人信息及保存在焦点网中的非公开内容，除非有下列情况：
?（1）有关法律规定和程序，搜房网合法服务程序规定；
?（2）保持维护搜房网的商标所有权和其他合法权益；
?（3）在紧急情况下竭力维护用户个人和社会大众的隐私安全；
?（4）与搜房网的关联公司和战略合作伙伴分享客户资料，以及其他需要公开、编辑或透露个人信息的情况。
另外，在以下（包括但不限于）几种情况下，搜房网有权使用用户的个人信息：
（1）在进行促销、抽奖、捐助等社会或商业活动时，搜房网可能会与赞助商共享用户的个人信息，在这些情况下搜房网会在发送用户信息之前进行提示，并且用户可以通过不参与来终止传送过程；
（2）搜房网会通过透露合计用户统计数据，向未来的合作伙伴、广告商及其他第三方以及为了其他合法目的而描述搜房网的服务；
（3）搜房网可以将用户信息与第三方数据匹配；
（4）搜房网会向用户发送客户订制的信息或者其它搜房网认为用户会感兴趣的其他信息。如果用户不希望收到这样的信息，只需在提供个人信息时或其他任何时候告知即可；
（5）另外，搜房网会采取行业惯用措施保护用户信息的安全，但搜房网不能确信或保证任何个人信息的安全性，用户须自己承担风险。比如用户联机公布可被公众访问的个人信息时，用户有可能会收到未经用户同意的信息；搜房网的合作伙伴和可通过搜房网访问的第三方因特网站点和服务；通过抽奖、促销等活动得知用户个人信息的第三方会进行独立的数据收集工作等活动。搜房网对用户及其他任何第三方的上述行为，不承担任何责任。
4．用户信息的存储与限制???????????
搜房网不对用户所发布信息的删除或储存失败负责。搜房并不承诺对用户的存储信息进行无限期保留。除非本协议中另有规定，否则搜房网不保证服务一定会满足用户的使用要求，也不保证服务不会受中断，对服务的及时性、安全性、准确性也不作担保。搜房网有判定用户的行为是否符合搜房网服务条款的要求和精神的保留权利，如果用户违背了服务条款的规定，搜房网有中断对其提供网络服务的权利。搜房网运用自己的操作系统通过国际互联网向用户提供丰富的网上资源，包括各种信息工具、网上论坛、个性化内容等。除非另有明确规定，增强或强化目前服务的任何新功能，包括新产品、栏目，均无条件地适用本服务条款。
5．服务条款的修改
搜房网有权在必要时修改服务条款。搜房网服务条款一旦发生变动，将会在重要页面上提示所修改的内容。如果不同意所改动的内容，用户可以主动取消获得的网络服务。如果用户继续享用网络服务，则视为接受服务条款的变动。搜房网保留随时修改或中断服务而不需照知用户的权利。搜房网行使修改或中断服务的权利，不需对用户或第三方负责。
6．拒绝提供担保
??用户对网络服务的使用承担风险。搜房网对此不作任何类型的担保，不论是明确的或隐含的，但是不对商业性的隐含担保、特定目的和不违反规定的适当担保作限制。
7．有限责任
??搜房网对任何直接、间接、偶然、特殊及继起的损害不负责任，这些损害可能来自：不正当使用网络服务，在网上购买商品或进行同类型服务，在网上进行交易，非法使用网络服务或用户传送的信息有所变动。
8．服务的结束
用户或搜房网可随时根据实际情况中断一项或多项网络服务。搜房网不需对任何个人或第三方负责而随时中断服务。用户对后来的条款修改有异议，或对搜房网的服务不满，可以行使如下权利：
（1）停止使用搜房网的网络服务；
（2）通告搜房网停止对该用户的服务。结束用户服务后，用户使用网络服务的权利马上中止。从那时起，用户没有权利，搜房网也没有义务传送任何未处理的信息或未完成的服务给用户或第三方。
9．用户管理
用户单独承担发布内容的责任。用户对服务的使用是根据所有适用于搜房网的国家法律、地方法律和国际法律标准的。
用户必须遵循：
（1）从中国境内向外传输技术性资料时必须符合中国有关法规；
??（2）使用网络服务不作非法用途；
??（3）不干扰或混乱网络服务；
（4）遵守所有使用网络服务的网络协议、规定、程序和惯例。
（5）用户的密码和帐号遭到未授权的使用或发生其他任何安全问题，用户可以立即通知搜房网，并且用户在每次连线结束，应结束帐号使用，否则用户可能得不到搜房网的安全保护。
（6）禁止用户从事以下行为：
1）上载、张贴、发送或传送任何非法、反动、淫秽、粗俗、猥亵的，胁迫、骚扰、中伤他人、诽谤、侵害他人隐私或诋毁他人名誉或商誉的，种族歧视、危害未成年人或其他不适当的信息或电子邮件，包括但不限于资讯、资料、文字、软件、音乐、照片、图形、信息或其他资料（以下简称内容）。
